CAR Issues Notice Re Heffernan’s Travel Claims and Renews Licence for One Foot Abroad

The Commission for Aviation Regulation (CAR) has issued an ‘Important Notice’ regarding the deadline for claims against the bond of Heffernan’s Shipping & Tourist Agency Ltd, and has renewed the travel agent licence for One Foot Abroad / Follow The Camino.

Heffernan’s Travel

The notice concerning Heffernan’s Shipping & Tourist Agency Ltd reads as follows:

Important Notice regarding Deadline for Heffernan’s Shipping & Tourist Agency Limited, trading as Heffernan’s Travel and Easy Travel Claims

Claims against the bond must comply with section 13 of the Transport (Tour Operators and Travel Agents) Act, 1982. Customers may only make a valid claim if they have incurred loss or liability because of the inability or failure of the travel agent or tour operator to meet their financial or contractual obligations to the customer under an overseas travel contract.

Pursuant to the Transport (Tour Operators and Travel Agents) Act, 1982 (Claims by Customers) Regulations, S.I. No. 104 of 1983, customers are required to make a claim in writing using this form and to provide proof of loss.

Proof of loss includes relevant receipts, invoices, bank statements and credit card statements and other relevant documentation to be provided to the Commission to demonstrate actual payments made in relation to the loss claimed.

As set out further below not all transactions between a customer and a travel agent or tour operator are covered by the bond. Customers may also want to take note of the chargeback rules in relation to credit cards. Customers are required to make a claim within 60 days of the date from which the tour operator or travel agent failed or was unable to meet their contractual obligations to the customers. Customers are encouraged to make claims promptly with such proof of loss as is available to them at that time. If the Commission requires further proof of loss it will request that from customers.

THE LAST DATE FOR RECEIPT OF COMPLETED REFUND CLAIM FORMS REGARDING HEFFERNAN’S SHIPPING & TOURIST AGENCY LIMITED, TRADING AS HEFFERNAN’S TRAVEL AND EASY TRAVEL, IS 5.00PM ON MONDAY 3RD DECEMBER 2018. ANY CLAIMS RECEIVED AFTER THIS DEADLINE CANNOT BE PROCESSED.

Travel Agent Licences

The Commission has also renewed the travel agent licence for One Foot Abroad Ltd, trading as One Foot Abroad and Follow The Camino, licence number 0785, until 31st October 2019.

Sol International Travel Ltd, trading as Sol Travel, licence number 0070, has deleted its branch at 45 Bridge Street, Tralee, Co Kerry, but continues trading at 5 Bridge Place, Tralee, Co Kerry.
